Abrego Garcia is probably the most high profile example of someone who has been returned from deportation and has been successful in fighting back against Trump’s efforts. They’re still fighting it on appeals, but it doesn’t seem likely that they’re going to win. Mahmoud Khalil is another.
In general, it is looking more and more likely that Trump’s entire immigration strategy of using the Alien Enemies Act is inevitably going to get struck down altogether, but that’s most likely going to go to the Supreme Court for a final ruling.
Recently a federal judge has permanently blocked Trump from sending the National Guard to Portland.
Almost all of Trump’s funding cuts have been overruled, due to him trying to supersede Congress’s authority over budget allocations.
There are hard lines that the Constitution is very clear about, and others that are more vague. Where the law is clear, Trump is getting stopped cold. Where it is less clear, all the cases are still ongoing, but have either been slowed down or straight up blocked pending appeal.
I know that it seems overwhelming, but so far Trump is losing the majority of the lawsuits against him. Where he is winning, is on smaller technicalities, or areas where they already had the right to do certain things, and therefore aren’t breaking any laws. But wherever the law is getting broken, the courts are working. That would be the only thing that would work…but that depends on what we do. Without a justification for declaring martial law, those same high-ranking military leaders will arrest him, before following those orders. This isn’t politics to them. They don’t have that kind of allegiance. Anyone who’s actually served in the military will tell you…the higher up the chain of command you go, the more seriously they take their responsibilities.

Except we aren’t. One of Trump’s biggest advantages, is his ability to convince people that he can do whatever he wants. It makes everyone around him behave as if he can. Some let him. Others don’t. Fascism is here, that’s true. But it doesn’t have control yet. We have to give him that control. He can’t just take what isn’t given to him. That’s what the courts still represent. He still needs to convince people that he has the authority to do things, or that authority is illegitimate.
That’s what will prevent the military from following his orders. He knows that. As much as he likes to act like he owns the whole show already…without legitimate authority, they will only follow him so far.
It’s a bit difficult to take you seriously when you argue that Garcia returned to the United States as an example that Trump lost—but Garcia is Again in custody… So that really is not a win. And despite him having “wins” in court, he’s still in custody… Which is not a win.

The vast majority of the United States will just fall in line and let it happen. Every single member of the military will do exactly as they are told. There will be no military generals or higher up officials fighting against him.
