Unlawful presence is not a crime at all - it’s a civil immigration violation.
- If someone overstayed a visa (about 40% of undocumented people), they never committed any crime
- Unlawful presence = civil matter handled in immigration court, not criminal court
- No criminal penalties, just deportation/removal
Being in the U.S. without valid legal status is a civil offense. It’s not criminal.
